Préambule
Le client déclare avoir pris connaissance des dispositions suivantes avant de passer commande des articles.
Il est de la responsabilité exclusive de chaque client de définir ses besoins, choisir les matériels adéquats et de s’assurer de la compatibilité des produits achetés.
La passation d’une commande implique de la part du client l’acceptation pleine et entière des présentes conditions générales de vente, ainsi que la pleine capacité juridique lui permettant de s’engager au titre de ces conditions générales de vente.
Nous pourrons modifier les présentes conditions générales de vente à tout moment sous réserve de faire apparaître ces modifications sur notre site.
Sécurité de paiement : tous nos paiements sont sécurisés par Paypal® et par Stripe®.

1. Validation
Vous déclarez avoir pris connaissance et accepté les présentes conditions générales de vente avant la passation de votre commande.
Le « clic » du visiteur constitue une signature électronique qui a valeur de signature manuscrite, et vaut acceptation des présentes conditions générales et engagement irrévocable.
2. Prix
Les prix de nos produits sont indiqués en Euros toutes taxes comprises. Les frais de traitement et d’expédition sont clairement indiqués. (Frais de port)
Les informations relatives aux prix peuvent faire l’objet de modifications et ne sont données qu’à titre indicatif.
Myriam Iticsohn se réserve le droit de modifier ses prix à tout moment mais les produits seront facturés sur la base des tarifs en vigueur au moment où la commande est enregistrée sous réserve de disponibilité.
3. Commande
Toutes les commandes, quelle que soit leur origine, sont payables en Euros.
Les commandes sont faites par courrier électronique et en ligne sur notre site Internet :
– Sur Internet : myriamiticsohn.com. Il sera accusé réception par courrier électronique, des commandes effectuées sur le site Internet. Il appartient au client de vérifier la confirmation de commande et d’avertir immédiatement Myriam Iticsohn de toute erreur.
Myriam Iticsohn se réserve le droit d’annuler ou de refuser toute commande d’un client avec lequel il existerait un litige relatif au paiement d’une commande antérieure.
Les factures sont jointes sur demande par mail au format PDF.

4. Livraison
Par courrier postal
Les produits sont livrés à l’adresse de livraison mentionnée par le client lors de la commande.
Le délai de livraison comprend le temps de préparation du colis et le temps d’acheminement. Notre transporteur est principalement La Poste, les délais de livraison sont en moyenne de 2 à 4 jours pour la France métropolitaine. Si vous choisissez de régler par virement, la commande ne sera traitée qu’à réception de celui-ci.
Toute commande livrée en dehors de la Communauté Européenne est susceptible d’être soumise à des taxes éventuelles et à des droits de douane. Le paiement de ces taxes et droits sont à la charge du client et relève de sa seule responsabilité.
Le client est tenu de vérifier l’état de l’emballage et la conformité du produit livré.
Le client doit, en cas d’avarie ou de manquant, refuser la livraison auprès du transporteur et informer Myriam Iticsohn de toute constatation nécessaire.
Myriam Iticsohn ne pourra être tenue responsable des conséquences dues à un retard de livraison de notre transporteur.
5. Frais de port
Les frais de port comprennent une participation aux frais de préparation et d’emballage + les coûts d’affranchissement. Ils sont clairement indiqués pour une commande en France métropolitaine. Pour toute commande provenant des DOM-TOM et de l’étranger, il est préférable de nous contacter.
Les frais de port sont dûs à chaque commande passée. Ils sont calculés en fonction du pays de destination. En cas de doute, nous contacter par E-mail : contact@myriamiticsohn.com
6. Paiement
Vous disposez de différents moyens de paiement:
a – En ligne par Carte bancaire ou Paypal ou Stripe.
b – Par virement bancaire après avoir eu notre accord par E-mail.
Myriam Iticsohn se réserve le droit de modifier ses prix à tout moment mais les produits seront facturés sur la base des tarifs en vigueur au moment de l’enregistrement des commandes, sous réserve de disponibilité.
Les produits demeurent la propriété de Myriam Iticsohn jusqu’au complet paiement du prix, notamment en cas du rejet du moyen de paiement.
7. Retours
7.1. Droit de rétractation
Conformément à la loi, le client dispose d’un délai de 14 (quatorze) jours ouvrés pour retourner, à ses frais, les produits neufs qui ne lui conviennent pas. Ce délai court à partir du jour de la livraison de la commande.
IMPORTANT : Seuls seront repris les produits renvoyés complets, dans leur emballage d’origine intact, et en parfait état de revente. Tout produit qui aura été abîmé ou dont l’emballage d’origine aura été détérioré, ne sera ni remboursé, ni échangé.
Ce droit de rétractation s’exerce sans pénalité, le client ne supportant que les frais d’envoi et de retour.
Le client peut demander soit le remboursement des sommes versées, soit l’échange du produit. Dans le cas d’un échange, les frais d’envoi et de retour seront à la charge du client.
Le droit de rétractation ne peut être exercé si le client a demandé et reçu son code d’activation pour un logiciel.
7.2. Non-conformité des produits
Les produits défectueux, abîmés ou non conformes à la commande seront repris, et remboursés ou échangés ou feront l’objet d’un avoir. Dans ce cas, nous vous remercions de bien vouloir en faire état de manière détaillée par écrit ou par E mail et de nous renvoyer le ou les produits. Myriam Iticsohn procédera à l’échange ou au remboursement du ou des produits. La demande doit être effectuée dans les 15 (quinze) jours ouvrés suivant la livraison.
8. Procédure de remboursement
En cas de demande de remboursement ou d’annulation de la commande, Myriam Iticsohn fera tous les efforts pour rembourser le client dans un délai de 30 jours à compter de la réception de la demande.
Le remboursement s’effectuera au choix de Myriam Iticsohn par virement Paypal ou par Stripe adressé au nom du client ayant passé la commande et à l’adresse de facturation si celle ci est en France Métropolitaine, par virement pour toute commande provenant de l’étranger.
9. Propriété Intellectuelle
Tous les textes, commentaires, ouvrages, illustrations et images contenus dans le site de Myriam Iticsohn sont réservés au titre du droit d’auteur ainsi qu’au titre de la propriété intellectuelle et pour le monde entier.
A ce titre, et conformément aux dispositions du Code de la Propriété Intellectuelle, seule est autorisée l’utilisation pour un usage privé. Toute autre utilisation est constitutive de contrefaçon et sanctionnée au titre de la Propriété Intellectuelle, sauf autorisation préalable des ayants-droits.
10. Responsabilité
Les produits proposés sont conformes à la législation française en vigueur. Myriam Iticsohn ne peut être tenu pour responsable en cas d’irrespect de la législation du pays où les produits sont livrés.
Myriam Iticsohn ne saurait être tenu pour responsable de l’inexécution du contrat conclu en cas de rupture de stock ou indisponibilité du produit, de force majeure, de perturbation ou grève totale ou partielle notamment des services postaux et moyens de transport et/ou communications, inondation, incendie.
Myriam Iticsohn n’est responsable que du contenu des pages qu’elle édite.
11. Droit applicable – Litiges
La langue du présent contrat est la langue française.
En cas de litige, les tribunaux français seront les seuls compétents.

Myriam Iticsohn s’engage à ne pas divulguer à des tiers les informations communiquées par le client.
Myriam Iticsohn ne collecte que les données strictement nécessaires au bon traitement des commandes ou pour faire-part des avantages, promotions et nouveautés, dont nous souhaitons faire bénéficier à notre clientèle.
Les informations qui sont demandées au client sont nécessaires au traitement de sa commande et sont destinées aux services de Myriam Iticsohn . En application de la loi n° 78-17 du 6 janvier 1978, le client dispose d’un droit d’accès aux informations le concernant. Sur demande, elles peuvent lui être communiquées et, en cas d’erreur ou de modification, être rectifiées.

4. Delivery
By letter
The products are delivered to the delivery address mentioned by the customer when ordering.
The delivery time includes the time of preparation of the parcel and the time of delivery. Our carrier is mainly La Poste, delivery times are on average 1 to 2 days for metropolitan France. If you choose to pay by bank transfer, the order will only be processed upon receipt.
Any order delivered outside the European Community may be subject to taxes and customs duties. The payment of these taxes and fees are the responsibility of the customer and is his sole responsibility.

5. Shipping costs

6. Payment
You have different means of payment:

Myriam Iticsohn reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in force at the time of the registration of the orders, subject to availability.
The products remain the property of Myriam Iticsohn until the complete payment of the price, in particular in the event of the rejection of the means of payment.
7. Returns
7.1. Right to retract
In accordance with the law, the customer has a period of 14 (fourteen) working days to return, at its expense, new products that do not suit him. This period runs from the day of delivery of the order.

11. Applicable law – Litigation
